Terms and Conditions for Blue Water Fishing Charter Website

Welcome to the Blue Water Fishing Charters website ("Website"). By accessing or using our Website, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our Website.  

1. Booking and Payment:

  • Reservations: All bookings are subject to availability. A reservation is only confirmed upon receipt of a deposit or full payment as specified at the time of booking.

  • Payment: We accept [List accepted payment methods, e.g., credit cards, cash, checks]. Full payment is due [Specify when full payment is due, e.g., 7 days prior to the charter date].

  • Cancellations: Our cancellation policy is as follows

Cancellations outside of 60 days will incur a 10% booking fee.

Cancellations within 30-60 days of departure will incur a 25% booking fee off total booking cost.

Cancellations within 30 days of departure will incur 50% booking fee off total booking cost.

Cancellations within 2-14 days of departure will incur 75% booking fee off total booking cost.

  • No refund will apply to cancellations within 48 hours of departure and no credit will be offered.

Wet season charter bookings are at your own risk. We will provide a credit or reschedule only.

  • Rescheduling: Rescheduling may be possible subject to availability and at our discretion, 

  • No-Shows: No-shows will be charged the full charter fee. Please arrive 30 minutes prior to departure. 

2. Charter Details:

  • Trip Duration: The duration of the charter is as specified at the time of booking. 

  • Meeting Point: The meeting point for the charter will be confirmed at the time of booking.

  • What's Included:ice, fuel, rods, bait tackle, non alcoholic beverages and all food / catering 

  • What's Not Included: transportation to and from the pick up / drop off. Alcohol is stictly BYO 

  • Catch:  only catches that are legal and of size / within the NT fisheries limits can be filleted and taken home by the customer if they wish. 

3. Conduct and Safety:

  • Skipper's Authority: The Skipper has the final authority on all matters relating to the charter, including decisions regarding safety, fishing locations, and trip duration.

  • Guest Conduct: Guests are expected to behave in a safe and responsible manner. Intoxication or disruptive behavior will not be tolerated and may result in the termination of the charter without refund.

  • Safety Regulations: Guests must comply with all safety regulations and instructions provided by the Skipper and crew.

  • Weather Conditions: Charters may be cancelled or shortened due to inclement weather conditions. The Skipper will make the final decision regarding safety.

4. Liability:

  • Disclaimer: Guests acknowledge that fishing and boating activities involve inherent risks, including but not limited to, injury, illness, and property damage. Guests assume all such risks."

  • Limitation of Liability: [Include a limitation of liability clause, limiting the company's financial responsibility in case of an incident. Consult with legal counsel to draft appropriate language.]

  • Indemnification: [Include an indemnification clause, stating that guests agree to hold the company harmless from any claims arising from their participation in the charter. Consult with legal counsel to draft appropriate language.]

5. Intellectual Property:

  • All content on this Website, including text, graphics, logos, and images, is the property of Top End Reel Escape Fishing Charters and is protected by copyright law.

6. Governing Law:

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Darwin Northern Territory. 

7. Changes to Terms and Conditions:

  • We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this Website.
